Welcome to Wittich-Photography's digital imagery sales platform. By purchasing digital images from our website, you agree to abide by the following terms and conditions. Please read them carefully before making any purchase.
2. Licensing and Use
All digital images sold by Wittich-Photography are licensed, not sold. By purchasing an image, you are granted a non-exclusive, non-transferable license to use the image for personal, non-commercial purposes only. Commercial use, reproduction, distribution, or resale of the images is strictly prohibited without prior written consent from Wittich-Photography.
3. Pricing and Payment
All prices are listed in USD and are subject to change without notice. Payment must be made in full at the time of purchase. Accepted payment methods include credit/debit cards, Stripe.
4. Delivery
Upon successful payment, you will receive a download link to access your purchased digital images. Please ensure you download and back up your files promptly, as the download link may expire after specified time period, e.g., 14 days.
5. Refunds and Exchanges
Due to the digital nature of our products, all sales are final. We do not offer refunds or exchanges for digital image purchases. If you experience any issues with your download, please contact our customer support team at christoph@wittich-photography.com for assistance.
6. Intellectual Property
All digital images are the intellectual property of Wittich-Photography and are protected by copyright laws. Unauthorized use, alteration, or reproduction of any images without prior permission is strictly prohibited and may result in legal action.

Digital Image Licensing Agreement
Effective Date: 5/23/18
1. Introduction
This Digital Image Licensing Agreement ("Agreement") sets forth the terms and conditions under which [Wittich Photography] ("we", "us", "our") grants you ("Licensee") a license to use digital images ("Images") purchased from our website [www.wittich-photography.com].
2. Grant of License
By purchasing Images from us, you are granted a non-exclusive, non-transferable license to use the Images subject to the terms and conditions outlined in this Agreement.
3. Permitted Uses
You are allowed to use the Images for the following purposes:
Personal Use: Display on personal websites, social media profiles, and personal digital devices.
Editorial Use: Use in news articles, blogs, or other editorial content, provided appropriate credit is given to Wittich Photography.
Non-Commercial Use: Use in educational materials, personal projects, and other non-commercial purposes.
4. Prohibited Uses
The following uses are strictly prohibited:
Commercial Use: Any use intended for commercial gain, including but not limited to advertising, marketing, promotional materials, and product packaging, without prior written consent.
Resale or Redistribution: Selling, licensing, sublicensing, renting, or distributing the Images to any third party.
Derivative Works: Creating derivative works based on the Images without explicit permission.

5. Intellectual Property Rights
All rights, title, and interest in and to the Images, including all copyrights and other intellectual property rights, are and shall remain the exclusive property of Wittich Photography. This Agreement does not transfer any ownership rights to the Licensee.
6. Attribution
When using the Images in an editorial context, you must include the following credit line: "Image courtesy of Wittich Photography."
7. Termination
This Agreement is effective until terminated. Wittich Photography reserves the right to terminate this Agreement at any time if you breach any of its terms. Upon termination, you must immediately cease all use of the Images and destroy any copies in your possession or control.
8. Limitation of Liability
To the maximum extent permitted by law, Wittich Photography shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of the Images.
9. Indemnification
You agree to indemnify, defend, and hold harmless Wittich Photography from and against any and all claims, liabilities, damages, losses, and expenses arising out of or in connection with your use of the Images or your breach of this Agreement.
10. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the state of Illinois, without regard to its conflict of law principles.
11. Changes to this Agreement
We reserve the right to modify this Agreement at any time. Any changes will be posted on our website, and your continued use of the Images after such modifications constitutes your acceptance of the new terms.
